Resolution of 29/07/2021, of the Regional Ministry of Agriculture, Water and Rural Development, approving a normal modification of the specifications for wines with Protected Designation of Origin Almansa and publishing the modified consolidated single document and the modified consolidated specifications. [2021/8937]
El día 3 de marzo de 2021 la Asociación de Productores de Vino con Denominación de Origen Almansa, presenta solicitud de modificación del Pliego de Condiciones de la Denominación de Origen Protegida «Almansa».
The proposed amendment involves aspects of the two categories of amendments indicated in Article 14 of Commission Delegated Regulation (EU) 2019/33 of 17 October 2018 supplementing Regulation (EU) No 1308/2013 of the European Parliament and of the Council as regards applications for protection of designations of origin, geographical indications and traditional terms in the wine sector, objection procedure, restrictions on use, amendments to specifications, cancellation of protection, and labelling and presentation. The scope of this resolution concerns modifications of a normal nature, specifically, it modifies: point 2.1 on analytical characteristics; point 2.2 on organoleptic characteristics; point 3 on specific oenological practices; point 5 on maximum authorised yield; point 6 incorporating new varieties, point 8.a in which the normative references are updated, and point 9 updates the list of control bodies.
Having examined the application submitted, it is considered to meet the conditions and requirements laid down in Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing the common organisation of the markets in agricultural products and repealing Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007.
The Resolution of 20 May 2021, of the Directorate General for Food, publicising the request for modification of the specifications of the Protected Designation of Origin “Almansa”, was published in the BOE (Official State Gazette) number 129 of 31 May 2021.
Article 17(2) of Commission Delegated Regulation (EU) 2019/33 of 17 October 2018 provides that if the Member State considers that the requirements of Regulation (EU) No 1308/2013 and the provisions adopted pursuant thereto are met, it may approve and make public the normal amendment. It also provides that the
approval decision shall include the amended consolidated single document, where appropriate, and the amended consolidated tender documents.
Whereas the amendments requested on 3 March 2021 by the Asociación de Productores de Vino con Denominación de Origen Almansa, listed above, are normal amendments, in accordance with the provisions of Article 14.1 of the above-mentioned Commission Delegated Regulation (EU) 2019/33 of 17 October 2019
2018 and that no opposition to the requested modification has been filed.
In exercise of the competences attributed to this Regional Ministry in matters of protected designations of origin and geographical indications in article 1.2 f) of Decree 83/2019, of 16/07/2019, establishing the organic structure and competences of the Regional Ministry of Agriculture, Water and Rural Development, I have resolved:
First. To approve the normal modifications to the specifications for wines with protected designation of origin “Almansa”, requested by the Association of Wine Producers with Designation of Origin Almansa on 3 March 2021.
Second. To publish the modified consolidated single document and the modified consolidated specifications for wines with protected designation of origin “Almansa” as Annexes I and II respectively to this resolution.
Third. The normal modifications indicated in the first paragraph shall be applicable in Spain from the date of publication of this resolution. In accordance with the provisions of Article 17.7 of Regulation YEAR XL No. 150 6 August 2021 29359
Delegated Regulation (EU) 2019/33 of the Commission of 17 October 2018 shall apply within the territory of the Union once they have been published in the Official Journal of the European Union, C series.
This Resolution puts an end to the administrative process, and against it the interested parties may lodge an appeal for reconsideration before the head of the Department of Agriculture, Water and Rural Development within one month, as provided in Articles 123 and 124 of Law 39/2015, of 1 January 2015.
October, of the Common Administrative Procedure of the Public Administrations or lodge a contentious-administrative appeal before the High Court of Justice of Castilla-La Mancha, in accordance with the provisions of Article 10 of Law 29/1998, of 13 July, regulating the Contentious-Administrative Jurisdiction, within a period of two months, both periods being calculated from the day following the publication of this resolution in the DOCM (Official Journal of the Region of Castilla-La Mancha).
In accordance with the provisions of Article 14 of Law 39/2015, of 1 October, the filing of any appeal may be made through electronic means, unless there is an obligation to relate with the Public Administrations by electronic means, through the corresponding link of the electronic headquarters of the Junta de Comunidades de Castilla-La Mancha (www.jccm.es).
